Forest Tenure

These Regulations amend the Town and Country Planning (Tree Preservation Order and Trees in Conservation Areas) (Scotland) Regulations 2010 in regulation 8, which disapplies section 172 of the Town and Country Planning (Scotland) Act 1997 on protection of trees in conservation areas which are not subject to a tree preservation order.

The present Regulation is made under the Private Managed Forest Land Act. The Regulation provides for the establishment of water quality objectives , Council review of requests with respect to administration and exit fees, remediation orders and offences. The text consists of 5 sections.

These Regulations provide for the protection of trees. The Department of the Environment may make tree preservation orders. An Order shall be in the form set out in the Schedule and these Regulations prescribe the procedure for their making, modification, confirmation and revocation.

Areas of public forest and pasture maybe leased to public or private entities through public biddings. The designated bodies for examining and approving the awards, rules of procedure, and the type of activities allowed on these areas are provided for in the Instruction.

These Rules, made under the Forest, Soil and Water Conservation Act, provide with respect to management and protection of Crown lands, and in particular of forest resources on such land.
