Documento de trabajo sobre tenencia de la tierra 11. Esta publicación compartida por la FAO y Naciones Unidas-Hábitat trata de comprender y definir mejor los procesos, los mecanismos y las instituciones de la gobernanza de la tenencia en áreas rurales y urbanas. En el documento se reconoce que se han realizado excelentes políticas de la tierra, leyes y reformas técnicas. Sin embargo, su implementación en muchos casos ha sido errónea, ha sufrido retrasos o, incluso, se ha invertido.

Given the recent trend of granting vast areas of African land to foreign investors, the urgency of placing real ownership in the hands of the people living and making their livelihood upon lands held according to custom cannot be overstated. This study provides guidance on how best to recognize and protect the land rights of the rural poor. Protecting and enforcing the land rights of rural Africans may be best done by passing laws that elevate existing customary land rights up into nations' formal legal frameworks thereby making customary land rights equal to documented land claims.

En 1999, la FAO publiait la première version française du Thésaurus multilingue du foncier. Cette version avait surtout pour vocation d'être mise à l'épreuve du terrain, c'est-à-dire soumise aux critiques constructives tant des usagers à la recherche d'informations et d'éclairages nouveaux que des experts du foncier. En effet, sur le fond comme sur la forme, sont apparus un certain nombre de points forts mais aussi des lacunes, relevés depuis 1999 par l'équipe des rédacteurs et par de nombreux autres spécialistes du foncier.

HIV and AIDS has exacerbated the vulnerability of orphaned children who are suffering in a vicious cycle of poverty, food insecurity, lack of access to education, and insecure livelihoods. Moreover, orphaned children are exposed to various forms of abuse by close family members, many of whom are their guardians. Movable and immovable properties that are left by their deceased parents are often confiscated by such guardians.

Este documento describe la perspectiva de las partes interesadas sobre el desarrollo de las Directrices voluntarias sobre la gobernanza de la tenencia. Estas directrices representan la mayor medida de un “terreno común\" sobre la gobernanza de la tenencia que se ha encontrado hasta el momento en el foro mundial. El consenso fue desarrollado por medio de negociaciones intergubernamentales con la participación de la sociedad civil, el sector privado e instituciones académicos y de investigación.

Cette étude propose une analyse de la dimension de genre au sein de la législation relative à l’agriculture et examine le statut juridique des femmes dans trois secteurs clés. Le résultat est une analyse qui identifie les principaux facteurs juridiques et certains facteurs non juridiques ayant une incidence sur l’existence et l’exercice des droits des femmes liés à l’agriculture.

Women make significant contributions to the rural economy in all developing country regions. Their roles OF FOOD AND AGRICULTURE differ across regions, yet they consistently have less access than men to the resources and opportunities they need to be more productive. Increasing women’s access to land, livestock, education, financial services, extension, technology and rural employment would boost their productivity and generate gains in terms of agricultural production, food security, economic growth and social welfare.

Good Governance in Land Administration

Desde os primórdios desta antiga prática, o cultivo tem sido a espinha dorsal do desenvolvimento econômico de muitas sociedades e a principal fonte de preservação e evolução da vida. Nas civilizações pré-históricas e agrárias mais antigas, a agricultura não somente era uma fonte de alimento e de matérias-primas, mas também representava uma fonte de expressão da ordem inata da natureza.
