Law No. 9407 amending Law No. 7843 on the immovable property registration.

The present Law lays down certain amendments to Law No. 7843 on the registration of immovable property, mainly dealing with the status of the Central Office for Immovable Property Registration. It changes the name of the office into the Office for Immovable Property Registration and provides further changes to the office structure, organization and activities scope.

This Law supplements Law No. 7843 on the registration of immovable property. It is hereby recognized the right of access to the unclassified documents and information. The addenda also deal with the status of the Central Office of the Immovable Property Registration. The Chief Registrar shall be in charge of the organization and management of the Office, shall designate the registrars and assistants and shall approve the organizational structure of the office. The procedures for registration of the transactions with immovable property are amended as well.

Form R.L. 4 is amended by deleting the attestation clause and substituting therefore a new clause. This form concerns the transfer by a chargee in exercise of power of sale.

This form concerns transfer by personal representative of a deceased person to person entitled to become proprietor under a will or on an intestacy and the declaration of the transferees that they hold that interest as proprietors in common undivided shares.

The present Regulation lays down provisions relating to electronic registration under the Land Registration Reform Act. Section 2 establishes that no person shall submit a document for electronic registration until having obtained a registration account number or other authorization from the land registrar of the land registry office where the person submits the document or a person authorized by the Director. The text consists of 41 sections.

This Decree contains rules relative to various stages of and the procedures for the partition of land in accordance with the Land Partition Act. It also defines the duties of local authorities in this process. The stages are, among other things, survey and mapping, the establishment of borders of land, distribution of registration numbers and assignment of an official address.

Ministerial Decree No. 710 on keeping the state land cadastre.

The Ministerial Decree establishes the modalities of keeping the state land cadastre containing data on land classification, dimensions and boundaries of the plots of land, land registration and valuation. Data of the state land cadastre shall be used for land use planning and land protection, land transactions and land valuation. A registration unit shall be a separated plot of land closed up by boundaries and allotted to a subject of land property relations.

This Legislative Decree aims at the regulatins of unregistered land sale contracts. The present Decree is composed of 10 articles. Article 1 deals with the scope of the Decree. Articles 2-5 provide for the establishment of the Dispute Settlement Committee and lay down its competencies and duties. Articles 6-8 refer to the role of the Court. Article 9 abrogates articles 2 and 3 of Law No. 1 on Cadastre.
