The Circular states the procedures for the mortgage of the land use right value and assets affixed to land by foreign investors at credit institutions; it defines the terms for presenting documents, dossiers, maps of the land, and prices as determined by appointed Committees in the provinces and cities where land is available to be mortgaged.

This Resolution subjects the comprehending areas of the Castelo de Bode dam to preventive measures. The underlined preventive measures are: prohibition of creating accesses to the dam; prohibition of creating infrastructures besides those for public bathing use whose construction license is that previous to the publication of this Resolution; use prohibition of effluent productors other than those found connected to treatment plants localized in an urban perimeter defined in the urbanization plan.

Actually, the amendments and implementations deal mostly with the legal bodies that are indicated as competent in terms of approval and assignment of land use, the activities related to those assignments, procedures involved in order to modify use rights, the certification of use rights, the subjects entitled to those rights.

This Act provides for the tenancy of land that shall be used for purposes other than cultivation; and for the building of residential housing or factories or for erecting shrines and temples and digging tanks. Nevertheless, the tenant or the sub-tenant is entitled to fell trees planted on that land, dispose of harvested fruits and flowers produced by the trees, and, even, to sow any plant or flower.

The Act provides for land allotment to evacuees, land to be used for agricultural production, pasture, house-building: it entitles the evacuee to the right of using the allotted land and, in those cases when allotments were not conceded prior to the issuing of the present Act, it provides for granting them in those cases when claims are compliant with the law.

The Ordinance refers to a Bangladesh custom of leasing land, called barga, and to the tenant of that lease, the bargadar, who is an individual tending the land whose property belongs to a different owner. It states that cultivating land belonging to another person and sharing the resulting production is consented only under a barga contract.

This Ordinance rules that land that has not been cultivated for at least two years shall be reclaimed by the Collector for a period not longer than one year from the initial declaration of acquisition, who can lease it to anybody for cultivating crops (food crops as per art. 2, clause ii). If the owner of the reclaimed land wants it back, he must notify his decision to the Collector no later than three months before the one-year expiration date, including the deposit of 50 TK/acre.

The amendments concern the need for authorization from the Ministry of Natural Resources and Agriculture for the conversion of forest and valley land into the following: 1. making farmland, orchard, rangeland, artificial forests, forage land, livestock institutions, aquatic breeding institutions, as well as the use for mine exploting and exploration (in nothern Iran); and 2. establishment of factories, townships, schools, training institutions, sport clubs, etc.

These Rules, which have been adopted in accordance with Sections 14 and 445 of the National Land Code, make provision as regards application for land, disposal of land and matters connected therewith within the federal territory of Kuala Lumpur. The Rules are divided into ten parts as follows: (I) Preliminary; (II) Application for Land; (III) Premium; (IV) Rent; (V) Temporary Occupation of Land; (VI) Removal of Rock Material; (VII) Permit to Use Air Space; (VIII) Sale of Federal Land By Auction; (IX) Compounding of Offences; (X) Miscellaneous.

The Regulation provides for the Location Licence issued to Companies assessing their right of using land as part of their activities. Exemption are provided for Companies whose land is part of the shareholders’ assets, or it is located in an industrial zone, or is part of an expansion of the Company business operations or in case the extension of land intended for agribusiness doesn’t exceed 25 Ha or less than 10.000 m2 in case of non agribusiness. Location licence covers one year for a 25 Ha area, two years for a 25-50 Ha area and three years for a 50 Ha area.

The Regulation provides for the recognition of traditional land rights acquired by a community of people who derives their living by cultivating or otherwise disposing of that very land and they shall be entitled to those rights as per the application of local traditional law.
