Climate Change (Management) Act 2015 (No. 19 of 2015).

This Act provides a framework for the development and implementation of measures in Papua New Guinea to combat climate change in accordance with the Kyoto Protocol and other international agreements and programmes. The Act establishes the Climate Change and Development Authority, the National Climate Change Board, a Screening Committee and the Climate Change and Green Growth Trust Fund. It provides with respect to climate change related project agreements, i.e. agreements between the Authority, the customary owners of the land and forest resources and the project proponent relating to an Agreement on REDD, REDD+, CDM or other Voluntary Carbon Offset Projects and any future climate change emission reduction mechanisms agreed to by the government that will facilitate for sustainable development and reduction of greenhouse gas emissions.The Act primarily concerns the limitation of use of "targeted greenhouse gases", i.e. carbon dioxide (C02), methane (CH4), nitrous oxide (N20), hydro fluorocarbons (HFCs), perfluorocarbons (PFCs), sulphur hexafluoride (SF6) or any other targeted greenhouse gas declared by the Head of State acting on the advice of the Minister as a targeted greenhouse gas for the purposes of this definition.The main function of the Board is to provide general control and guidance over the exercise of the functions and powers of the Authority. Functions and powers of the Authority and the Board are defined. Climate change trust funds established under the Public Finances (Management) Act 1995 shall be combined and collectively called the Climate Change and Green Growth Trust Fund.Each person or entity that carries on an activity in a regulated sector shall keep records of - (a) the emission in the country of greenhouse gases into the atmosphere; and (b) the removal of greenhouse gases to a sink in the country, and such further or other matters prescribed by regulation and shall - (a) submit such records for verification by a registered verifier; and (b) submit those verified records annually to the Authority. The Act furthermore provides with respect to, among other things: national reporting; implement of carbon dioxide emission and targeted greenhouse gas emission mitigation actions; implementation of climate change and climate compatible adaptation actions (including adaptation plans); regulation of climate change adaptation; free, prior and informed consent" process for customary landholders; rights and benefits of customary landholders and other landholders in climate change related project agreements; data collection, monitoring and reporting.
