This law regulates expropriation in the sense of article 18 of the Constitution of Afghanistan and defines purposes that shall constitute “public welfare”, i.e. purposes that justify expropriation. Purposes include construction of roads, channels, dams, water reserves for the fighting of fires and other (specified) construction for public use. If public welfare exists shall be established by the appropriate local authorities. Plans for expropriation shall be prepared by the competent authorities. Remaining provisions deal with compensation and compulsory acquisition in the case of the purchase of cultivated land in part so that the remaining land cannot be effectively used for cultivation.
