This Act consists of 54 sections divided into 5 Parts: Registration (I); Investigation of Title (II); Alienation of Niuean Land (III); Surveys (IV); Miscellaneous Provisions (V).There shall be kept in the Land Registry a Land Register of Niuen and Crown land. Every instrument affecting or relating to the title to any land shall be registered, except titles specified in section 4. The Act deals with the transfer of property from an individual to another by means of sale, mortgage (as per point a), lease, exchange (i.e exchanging the property of land with crops) or donation. In this last case, donation must be accepted by the person in the course of the donor’s lifetime. If the recipient dies before having accepted the donation, this shall be considered null.

The Ordinance refers to a Bangladesh custom of leasing land, called barga, and to the tenant of that lease, the bargadar, who is an individual tending the land whose property belongs to a different owner. It states that cultivating land belonging to another person and sharing the resulting production is consented only under a barga contract.

This Act provides for the tenancy of land that shall be used for purposes other than cultivation; and for the building of residential housing or factories or for erecting shrines and temples and digging tanks. Nevertheless, the tenant or the sub-tenant is entitled to fell trees planted on that land, dispose of harvested fruits and flowers produced by the trees, and, even, to sow any plant or flower.

A lease of State lands that was registered under the Real Property Ordinance after 27 October 2000 but before the commencement of the State Lands (Amendment) Act, 2003: (a) is valid and lawful to the extent that it would have been valid and lawful had the Ordinance provided for such registration; and (b) shall continue to be treated with, in accordance with the Ordinance, and such treatment shall be valid and lawful to the extent that it would have been had the Ordinance provided for the registration of the said lease.

A ces fins, il répartit les terres domaniales en 2 catégories, à savoir: les terrains situés à l'intérieur des circoscriptions urbaines; les terrains situés en dehors des limites des circoscriptions urbaines, les terres rurales; ces catégories s'appliquent aux terrains à bâtir, aux terrains agricoles ou d'élevage et aux terrains destinés à d'autres usages.
