L’article 1er du susdit Code établit que le territoire de la Région wallonne est un patrimoine commun de ses habitants. La Région et les autres autorités publiques, chacune dans le cadre de ses compétences et en coordination avec la Région, sont gestionnaires et garants de l’aménagement du territoire.

Section 1 of the above-mentioned Order establishes that the lands described in Schedule II of the Territorial Land Act being required for the protection of wildlife, wetlands and associated habitat, are hereby withdrawn from disposal under the Territorial Lands Act. Section 2 rules that the lands described in Schedule III, being required for the protection of wildlife, wetlands, and associated habitat, which lands are not in Schedule II, are hereby withdrawn from the application of the Canada Oil and Gas Act. The text consists of 4 sections and 3 Schedules.

The present Act lays down provisions relating to public lands. The Minister shall have charge of the management, sale and disposition of the public lands and forests. For the purpose of the present Act “mines and minerals” includes gold, silver, copper, lead, iron and other mines and minerals, and quarries, and beds of stone, marble or gypsum. The text consists of 75 sections divided into 4 Parts as follows: Ministry of Natural Resource (I); Road on public lands (II); Provisions of general application (III); Construction of dams (IV).

Surface Rights Acquisition and Compensation Act (R.S.S. 1978, c. S-65).

The present Act lays down provisions relating to the acquisition of surface rights to land and the determination and payment of compensation. In particular, the purposes of the Act are: a) to provide for a comprehensive procedure for acquiring surface rights; b) to provide for the payment of just and equitable compensation for the acquisition of surface rights; c) to provide for the maintenance and reclamation of the surface of land acquired in connection with surface rights acquired under this Act.

The present Act gives the Cabinet the ability to place conditions on the transfer or lease of lands listed in a Schedule to this Act. In particular, section 1 establishes that the Act applies to the lands, being the property of Her Majesty set out in the Schedule and to any other lands belonging to Her Majesty which may from time to time be added to the Schedule by the Lieutenant Governor in Council. This Law is composed of 13 articles. Article 1 decrees desert lands a private State property. Article 2 deals with the following matters: appropriation of desert lands before the issuance of this Law shall not considered an acquired rights of disposal or decision nor compensation either real rights on these lands; all tribunals, judicial committees and cadastre judges shall abstain from examination, decision, valuation and judgment in complaints and denunciations related to desert lands (Albadeya); and, stopping registration of desert lands.

This Act provides for local government in Guyana. It defines functions and powers of village councils, country councils and rural authorities.The Minister may enforce obligations of local authorities in the field of supply of water and sewerage and may exercise the powers of a local authority whenever is appears expedient to the Minister to do so. The Minister may also make By-laws for, among other things, the management and administration of villages and country districts and rights relating waterworks between villages or country districts.

This Act provides for local government of Amerindians, i.e. an Indian who is a member of a tribe indigenous to Guyana. For this purpose Amerindian Districts, Amerindian Areas and Amerindian Villages are established.The Act also provides for the protection of property of Amerindians and establishes the Amerindian Purposes Fund. The Minister may establish District Councils or Area Councils as a body corporate. The Councils shall, among other things, manage and regulate the use and occupation of land situated in a District, Area or Village.

This Law provides for the division of movable and immovable property.All movable and immovable property used and administered by the State of Cambodia until the date of this Law shall become the State property, while all movable and immovable property used and administered by the Cambodian People Party shall become the property of the Cambodian People Party. All property jointly used and administered shall be subject to negotiation between the parties for division.

Upper Austria Forest Land Division Law.

Article 1 of the above-mentioned Law establishes that the division of forest land as a result of which a remaining part of land would reach no longer the minimum size for forestry management is forbidden. The minimum size is 1 ha and a minimum width of 40 m. However, if the public interest prevails such divisions are permitted as, for instance, in case of water works, mining activities, energy resources, improvement of agricultural structure, land reform, and so on.
