Sont approuvées les modifications annexées au présent décret, apportées aux statuts-type des coopératives agricoles d'attributaires de lots domaniaux et/ou d'attributaires de lots constitués, sur d'anciens immeubles collectifs, concernant les articles 4, 13, 15, 16, 25, 42 et 43. Sont abrogées les dispositions des articles 31 et 32 des statuts-type des coopératives agricoles d'attributaires de lots domaniaux et/ou d'attributaires de lots constitués sur d'anciens immeubles collectifs.

Ministerial Decree No. 1153 on the protection of geodetic points.

The geodetic points pertain to the national property and are protected by the state. The plots of land on which the geodetic points are situated and one-meter wide strip of land along the boundaries thereof are fenced-off areas. Land pertaining to fenced-off areas of the geodetic point cannot be expropriated. The aforesaid land can be used for limited agricultural activities by special authorization.

Regulation No. 231 on refusal of ownership or possession of land and concerning requests to return land.

This Regulation concerns the refusal to own or possess land. There are hereby regulated the procedures appicable to requests for land. The land above-mentioned is considered to be State-owned land to be administered and distributed by the Ministry of Agriculture and Food. The refusal must be in written form and submitted to the village land distribution committee. Refusal of the land from village families does not affect their entitlement to social aid, whereas the refusal from agriculture enterprises families render the family ineligible for social aid.

Valuation for Rating Act.

This Act imposes a duty on local authorities to cause a valuation to be made of every rateable property within the area of the local authority in respect of which a rate on the value of land is imposed. This shall be done at least once in every five years or such longer period as the Minister may approve. The values of the valuation shall be entered in a valuation roll.This Act shall apply to any area of a local authority in respect of which any rate on the valuation of land, other than a rate on the annual value of agricultural land, in the area has been imposed by or under any Law.

La presente codificacion de la Ley de Tierras Baldias y Colonización, norma las tierras que forman parte del patrimonio del Instituto Nacional de Desarrollo Agrario (INDA), y dispone que no se considerarán tierras baldías, las tierras comunitarias de posesión ancestral de los pueblos indígenas que se autodefinen como nacionalidades de raíces ancestrales y de los pueblos negros o afroecuatorianos, así como, de las comunidades que forman parte de estas colectividades de conformidad a lo dispuesto en el Art. 84 de la Constitución Política de la República.

The Law determines the basic principles of the organization and regulation of activities in the fuel and energy sector. All primary energy resources shall be the exclusive property of the state and the management thereof shall be subject to licensing. The Law shall be applicable to energy production, transmission, storage and to such fuels as oil, natural gas, coal and renewable sources of energy.

State Land and River Reserves Act (Cap. 228).

This Act makes provision for the management and alienation of State land, for the appointment of forest rangers and for the protection of State lands and River Reserves.State land may be alienated by grant, sale or lease. State land may be sold by the President, with the exception of River Reserves belonging to the Republic. River Reserves are rivers and “rivulets” and adjacent areas listed in Schedule A to this Act. The Minister may, from time to time, add to or withdraw from the Schedule any watercourse.

Law No. 8047 on the administration of refused agricultural lands.

This Law defines the legal regime of refused agricultural lands (lands which are not accepted into use or ownership by farmers). Refused lands are considered as State agricultural lands. They are transferred to the administration of the General Directorate of Forests and Pastures. The latter, through its regional directorates and in collaboration with the land distribution commissions, determines the areas of refused lands based on the data given by the municipalities and communes and certified by the immovable property offices.

This Regulation amends articles 1(1), 1(2), 11(3) and 11(5) of Regulation No. 831 of 1998. According to these new provisions, the study on agricultural and forestry lands registered in the Immovable Property Office can be prepared by the Directorate of Agriculture and Food or the Forestry Service Directorate. These studies are then approved by the Ministry of Agriculture and Food.
