Legally recognized and secure land and resource rights are fundamental to the advancement of global peace, prosperity, and sustainability. From the development of human cultures to the realization of democracy itself, tenure security underpins the very fabric of human society and our relationship to the natural environment. Today, insecure tenure rights threaten the livelihoods and wellbeing of a third of the world’s population, and with it, the very future of our planet.

Reports & Research
Octobre, 2017
Kenya

The land registration system in Kenya was established in 1897 to support land registration for white settlers who had come into the country during the 19th Century. In the last one hundred years that the system has been in existence it has remained relatively the same; registry records are kept in paper format and the majority of operations are carried out on manual basis. This lack of a modern registration system has contributed to problems in land administration in the country.

The Kenyan Cadastre and Modern Land Administration

Journal Articles & Books

Kenya

Despite a history of more than 100 years and the introduction of provisional maps to support land registration, the Kenyan cadastre is largely incomplete. It consists of a patchwork of maps of different positional qualities, which would not be readily integrated to create a nation-wide coverage. This paper outlines the structure of the Kenyan cadastre and analyses the quality of the cadastral maps with regard to the requirements of modern land administration.

Analysis is prefaced with substantial background on legal trends continentally, but the focus is on Kenya’s Community Land Act, 2016, as the framework through which customary holdings are to be identified and registered.

Land registries play a key role in protecting landholders against dispossession and promoting good governance and economic development. Effective land agencies provide efficient and accessible land registration services, transparent land information, and clear ownership records to prevent disputes. Accurate records of property rights provide a basis for delivering services such as water or electricity, levying property taxes, enforcing zoning and environmental laws, and are necessary (although not sufficient) for landholders to use their properties as collateral.
