The purpose of the present Act is to: a) provide certainty in ownership of interests in land; b) simplify proof of ownership of interests in land; c) facilitate the economic and efficient execution of transactions affecting interests in land; and d) provide compensation for persons who sustain loss from a failure of the land registration system.

This Decree amends the Cadastre Decree and some other Decrees in relation to the entry into force of the Act No. 410 of 2003 to amend Cadastre Act and the Cadastre Organisation Act (adjustment of purposes and duties of Cadastre Service and other public registries), the revised Cadastre Act of 2005 and other legislation relative to ships and aircrafts. The amendments concern the new organization of the Cadastre.

The present Act introduces some amendments to the Land Titles Act (Chapter L-4). In particular, it repeals section 3; as well as section 5 which shall read as follows: “Deputy Registrar. The Deputy Registrar may do and perform all the duties required by this Act to be done or performed by the Registrar.” Furthermore, it adds a chapter after section 43 dealing with proof of identity; and one after section 50 concerning refusal to register.

L’article 7 établit que tout morcellement d'immeubles situés en zone agricole qui a pour effet de créer des parcelles d'une superficie inférieure à 25 ares est interdit. Cette surface est réduite à 15 ares pour les parcelles incorporées dans le cadastre viticole.(1) Des autorisations exceptionnelles peuvent toutefois être accordées par l'autorité compétente pour justes motifs, au sens des articles 59 et 60 de la loi fédérale, et si aucun intérêt prépondérant de l'agriculture n'est lésé.

The present Act introduces substantial amendments to the Land Titles Act. In particular, it amends section 3 by adding the following definitions in alphabetical order:“electronic instrument”,”prescribed form”, “subscriber”; it adds after section 17 a paragraph dealing with electronic instruments; it rewords section 21 concerning registered land.

The Contracting Parties shall cooperate in the following fields: (a) joint programmes in the sphere of cadastre, land resources, geodesy and cartography; (b) exchange of information; (c) exchange of maps; (d) exchange on experience related to land use planning, land survey and land cadastre; (e) joint symposia and conferences; (f) consulting (art. 2).

This Act of New Zealand, consisting of 24 Parts and three Schedules, provides for matters of government of the Cook Islands, for various matters of general law of the Cook Islands and for the administration of various matters relating to public and private land.The Act provides for the institution of Island Councils and the High Court of the Cook Islands. It defines criminal offences and prescribes criminal procedures.

The present Regulation implements the Federal Act on land law and land rights of 21 December 2004. In particular, it lays down provisions relating to land rights in the Canton of Obwalden. Furthermore, it establishes a Land Right Commission (Bodenrechtskommission).The said Commission shall, inter alias, survey subdivisions of agricultural land and registrations in the cadastre.
