El artículo 1º del Decreto define, conforme al artículo 104 bis de la Ley Nº 135, de 13 de diciembre de 1961, como pequeños arrendatarios, aparceros o similares, los que exploten extensiones que no excedan de 15 hectáreas. El artículo 2º establece que los contratos vigentes, escritos o verbales, con las excepciones de que trata el artículo 4º del Decreto, quedan prorrogados por el término de 10 años contados a partir de la sanción de la Ley Nº 1 de 26 de enero de 1968.

The centrepiece of the Law on Land Reform is the creation of Special Land Funds administered by local authorities, for the assignment of user rights thereon, including, in particular, lease rights, to individuals and concerns. Private ownership of land is contemplated only as a result of the disbanding of collective enterprises (art. 14), but it is the stated policy of the Republic of Tajikistan not to restore ownership of land formerly held by "ancestors" and religious institutions (art. 2.2).

The Act provides for a system for the disposal of national lands, i.e. lands held by the Government. National lands can be disposed of through lease (sect. 7) or sale (sect. 13). Leases are granted against payment of rent, arrears of which are recoverable in court (sect. 10). Applicants for leases in excess of 500 hectares must file an Environmental Impact Assessment, prior to the grant and every five years thereafter. The Minister has authority to impose this same requirement on applicants for leases covering a lesser land surface (sects. 9(4) and (5)).

This Act lays down basic provisions on land tenure, both urban and rural. land can be owned only by Lithuanian citizens, or by the State (art. 3). Private ownership of land conveys certain standard rights and privileges, amounting to the free and unimpeded enjoyment and disposition of the owner's property (art. 7). Usufructury rights accrue to the leaseholders of private and State-owned land (art. 8).

La presente Ley, que consta de 13 artículos, no permite la celebración de contratos de arrendamiento o de aparcería o de cualesquier otros de los que habitualmente se estipulan en las regiones rurales del país, como equivalentes a arrendamientos, que envuelvan la explotación indirecta de la tierra sobre extensiones inferiores al mínimo indispensable para el sostenimiento de una familia campesina (art. 1º).

Ley Nº 287 - Declara de interés social la resolución de todo contrato de arrendamiento relativo a tierras del Estado que excedan de 100 tareas, siempre que se trate de tierras irrigadas.

La Ley, que consta de 4 artículos, declara de interés social la resolución de todo contrato de arrendamiento relativo a tierras del Estado que excedan de 100 tareas, siempre que se trate de tierras irrigadas, hecho con particulares, cuando su distribución entre campesinos de escasos recursos económicos dedicados a la agricultura, se considere útil a juicio del Instituto Agrario Dominicano (art. 1º). Quedan exceptuados de la disposición los arrendamientos hechos para fines industriales, educativos, turísticos o de transporte aéreo o marítimo (art. 2º).

This Law is composed of 6 articles: public desert areas can be rented at nominal rates for investment projects (art. 1); the transfer of property will be completed after the realization of the project and effective production (art. 2); the rent period must not exceed (40) years, renewable as long as the project continues (art. 3); such land is to be used only for the designated objective (art. 6).

L'Etat peut consentir des baux emphytéotiques pour une durée de 50 ans sur les terrains faisant partie de son domaine privé. L'emphytéote, titulaire d'un droit réel susceptible d'hypothèque, peut entreprendre sur les fonds tous travaux, pourvu qu'ils ne diminuent pas la valeur des fonds. Les améliorations faites par le preneur restent à l'Etat à la fin du bail, sans indemnité.

It consists of 6 articles, concerning, inter alia: (a) the acknowledgement by the State of the applicant's right to manage and use the land according to the laws and regulations in force on the management and use of land and forest land; (b) the use of the land in accordance with the use targets established in article 2 and the control of the proper use of land by the State; (c) the offences to be inflicted in case of infringement of the provisions stipulated in the contract.
