Regional Law No. 41-RZ “On maximum land area of land plots allotted for subsidiary smallholding”.

El presente Decreto aprueba el Reglamento a la Ley que tiene como objetivo su correcta aplicación para la preservación del uso de los terrenos dedicados a actividades de producción primaria agropecuaria, ya sea que estén inscritos o no en el Registro Inmobiliario, mediante una adecuada valoración para los efectos del cálculo del Impuesto sobre Bienes Inmuebles, en la que el uso del suelo y la producción serán factores determinantes para definir la base imponible del impuesto.
The present Act provides for the setting up of experimental farm stations which are scientific research centres that investigate difficulties and potential improvements to food production and agribusiness. Experiment station scientists work with farmers, ranchers, suppliers, processors, and others involved in food production and agriculture. Section 5 deals with land for tree planting and timber, and section 6 concerns the application of the Expropriation Act in respect of the acquisition and taking possession of land. The text consists of 10 sections.
Article 1 shall be amended to add the following wording: “allotment of plots of land for individual housing construction, subsidiary smallholding, gardening and horticulture to families with disabled children”.

Article 2 shall be amended to add the following wording: “Plots of agricultural land shall be allotted to specific categories of citizens for agricultural production, other purposes related to agricultural production, for suburban farming and for individual housing construction”.

This Regional Law establishes cases of allotment of land plots free of charge in ownership to citizens with three and more children out of stock of public or municipal land. Land plots can be allotted to the aforesaid category of citizens for the following purposes: (a) individual housing construction; (b) suburban housing construction; (c) gardening and horticulture; (d) stockbreeding; and (e) farming.
This Regional Law establishes maximum land area limits for plots of agricultural land allotted on condition of ownership to citizens out of stock of public or municipal land as follows: (a) for peasant farming – 30 ha; (b) for horticulture, gardening, stockbreeding, suburban housing construction out of stock of low yield agricultural land – 1.500 square metres; and (c) for subsidiary smallholding – 5.000 square metres.
Article 7-1 shall be amended to add the following wording: “Citizen interested in obtaining in ownership plot of land shall submit written application to the local government containing a copy of identity card or other identifying document and birth certificate (adoption certificate) of children or copies of identity cards thereof”.

Article 2 shall be amended to add the following wording: “Maximum land area of the plots of agricultural land allotted free of charge to citizens out of the stock of public and municipal land in ownership shall be set forth as follows: (a) for horticulture, gardening, stockbreeding, suburban housing construction – 0.15 ha; and (b) for subsidiary smallholding – 0, 5.ha; and (c) for individual housing construction in rural areas – 0, 15 ha”.
This Regional Law regulates the issues of allotment once-only free of charge of agricultural land plots out of stock of public and municipal land in ownership to some categories of citizens, including multiple children (three and more) families, for peasant farming, subsidiary smallholding, horticulture, gardening and suburban individual housing construction. Order on allotment of land shall be issued and legalized by local government.
This Order classifies authorized uses of land plots and, in particular, use of agricultural land for plant cultivation, crops, horticulture, gardening, cultivation of medicinal plants, flax, hemp, ranching, stockbreeding, poultry farming, apiculture and fishfarming.
