These Regulations, made under section 128 of the Mines and Minerals Act, prescribe any circumstance when it is necessary or expedient in the interests of defence, public safety, public order, public health, town and country planning, or the development or utilization of any property for the public benefit to be a public purpose for the purposes of section 103 of the Act. Section 103 restricts the exercise of mining on land used for public purposes.

Mines and Minerals (Prescribed Operations) Regulations (Cap. 61:01).
These Regulations, made under section 128 of the Mines and Minerals Act, prescribe the operations which may be carried on under section 116 (4) of the Act. Such operations include breaking up the surface of any land for the purpose of collecting information on the geology and mineral resources of Malawi.
Mines and Minerals Act (Cap. 61:01).
This Act, among other things, vests the property of mineral rights in the President, provides with respect to the administration of matters regarding mines and minerals, provides for the granting of mineral rights and related matters, and provides for the protection of the environment in relation with mining operations. The Act also includes provisions concerning dispute resoluation.No person shall carry on in Malawi reconnaissance, prospecting or mining operations, except under and in accordance with a Mineral Right, a non-exclusive prospecting licence, a claim or a mineral permit.
Courts Act (Cap. 03:02).
This Act concerns the judicature in Malawi, constitutes the High Court, provides for the establishment of subordinate courts and provides with respect to jurisdiction and proceedings of the High Court and subordinate courts. Certain provisions concern jurisdiction or procedures regarding land matters including charging or mortgaging of land and land registration. The Chief Justice may establish District Registries and appoint Deputy District Registrars for each District. Courts of Magistrates of various grades are established throughout Malawi.
Smallholder Sugar Authority Order (Cap. 65:01).
This Order, made under section 4 of the Special Crops Act, establishes the Smallholder Sugar Authority for purposes of promoting and fostering the development of sugar-cane grown by smallholders on lands held under a sublease from the Dwangwa Sugar Corporation Limited to the Authority. “Smallholder” means a person who has been granted a right of occupancy or a tenancy under the Special Crops (Sugar-cane) (Licensing) Regulations.
