Land and Conveyancing Law Reform Act 2009 (No. 27 of 2009).

This Act provides for a comprehensive reform and modernization of land law and conveyancing law. It, among other things, provides for a simplification of the conveyancing process, especially the procedures involved and the taking of security over land; facilitates extension of the registration of title system with a view to promoting its use; and facilitates the introduction of an electronic conveyancing system.

This Regional Law establishes the modalities of calculation of lease for public land plots and land plots with undelimited ownership, allotted on lease without public tender (auction). It establishes calculation formula for lease of land.

The present Law implements the Land Parcel Act of 28 July 1961, the Land Lease Contracts Act of 8 November 1985, the Agricultural Adaption Act in its version of of 3 July 1991. In particular, the Law lays down provisions relating to the correct and efficient implementation of the afore-mentioned Acts. The text consists of 4 articles as follows: Agricultural authorities (1); Competences (2); Enforcement of the Land Parcel Act (3); Vocational training in agriculture and forestry (4).

These Regulations, consisting of 31 sections divided into eight Parts, make provision with respect to procedures of the Pastoral Land Board established under section 11 of the Act, legal issues of pastoral leases, monitoring of pastoral land, access to pastoral land, licences to go onto and take certain things from pastoral land, procedures of appeal with an Appeals Tribunal and miscellaneous matters.

The purpose of this Law is the establishment of market oriented conditions in the agricultural sector based on private ownership. Land transfer and the use of land as guarantee for land-based credit should promote the efficient operation of new businesses. This Law basically regulates the use of arable land and aims to create landed properties suitable for competitive agricultural production, avoiding to burden land with the effects of excessive subdivision.

This Regional Law establishes plenary powers of the regional Legislative Assembly, Governor, Regional Government and authorized regional state executive body in the sphere of land relations. It also establishes maximum agricultural land area (150 ha) and minimum agricultural land area (0, 5 ha) of public and municipal land that can be allotted in ownership for farming. The aforesaid plots of land can be allotted once-only.

This Law establishes that beginning from 1 March of 2015 the amount of lease payments for public plots of land and plots of land with undelimited ownership allotted on lease without tenders shall be fixed by the Regional Government if otherwise is not envisaged by Land Code of the Russian Federation and other federal laws.

Repeals: Regional Law No. 26-OZn “On lease of public land”. (2008-05-06)

This Act makes provision for the registration of land and provides, for this purpose, for an administrative framework, defines the effect of registration of land and regulates the procedures of registration, survey and combination, subdivision and re-parcelling of land. The Act also provides for the registration of lease of agricultural tenancies and its legal consequences.
