The purpose of this Act is to contribute to the sound development of the national land by providing for fundamental matters concerning the formulation and implementation of plans for and policies on the national land. The Act consists of 33 articles divided into 6 Chapters: General provisions (I); Formulation, etc. of national land plan (II); Efficient promotion of national land plan (III); Construction of national land information system, etc. (IV); National Land Policy Committee (V); Supplementary provisions (VI).

The present Regional Act, in compliance with the provisions contained in Act No. 183 of 1989 and Act No. 36 of 1994: (a) lays down rules governing the establishment of basins; (b) provides for the delimitation of areas of soil protection; (c) defines the procedures to be followed to adopt river basin plans; (d) aims at the protection and preservation of water resources.

Foreshore Act, 1933.

Section 2 allows the Minister to grant leases on the foreshore in the public interest. "Foreshore" means the bed and shore, below the line of high water of ordinary or medium tides, of the sea and of every tidal river and tidal estuary and of every channel, creek and bay of the sea or of any such river or estuary. Every lease shall contain prescribed clauses or covenants as listed in section 2.

The amendments of this Act to the Fisheries Acts, 1959 to 1997, the Foreshore Act, 1933, and the Fishery Harbour Centres Act, 1968 concern the granting of a foreshore licence for aquaculture purposes under the Act of 1933, or a fish culture licence under section 15 of Fisheries Acts, 1959 to 1997. These licences shall be deemed to an aquaculture licence granted under the Fisheries (Amendment) Act of 1997. Specific conditions are set out for the procedures of granting a foreshore licence deemed to be an aquaculture licence under the 1997 Act.

Beach Authority Act 2002 (No. 7 of 2002).

The Beach Authority, established under section 5 as a body corporate for purposes of this Act, shall be to ensure proper control and management of public beaches in Mauritius and Rodrigues, i.e. a space along the coast which, by notice published in the Gazette, has been declared to be a public beach by the Minister responsible for the subject of housing and lands. This space includes an area between the low water mark and the high water mark, and also the surrounding waters up to a distance of 100 meters.

Removal of Sand Act (RL 4/479).

This Act regulates the removal of sand on State lands. “Sand” includes stones, coral, earth and turf. The Minister may designate sand quarries and sand landing places. No sand removed from the sea or from a river shall be landed except at a sand landing place. No person shall carry on the business of dealer in sand unless he or she is the holder of a licence granted under section 5. The Minister may grant a lease of a sand quarry to a licensed dealer for such term and upon such conditions as he or she thinks fit (sect. 6).

The purpose of these Regulations is to facilitate compliance with the European Court of Justice ruling of 21 September 1999 (Case C-392/96) that the EIA thresholds adopted by Ireland in relation to initial afforestation and peat extraction exceeded the discretion available to Ireland under Directive 85/337/EEC on Environmental Impact Assessment in that they did not take account of the nature, location or cumulative effect of projects below these thresholds. The threshold for mandatory EIA in relation to these activities is reduced.

La présente ordonnance complète le dispositif législatif en matière forestière et donne un fondement juridique à l'intervention de l'Office national des forêts (ONF) et aux actes de gestion durable : elle étend l'essentiel du code forestier à la Guyane, avec les adaptations et dispositions spécifiques rendues nécessaires par le contexte et les enjeux particuliers de la forêt guyanaise. Cette ordonnance va permettre de s'engager dans une démarche d'écocertification. Le code du domaine de l'Etat est également modifié pour tenir compte de ces adaptations.

Landfill Tax (Amendment) Regulations 2004 (S.I. No. 769 of 2004).

These Regulations amend the principal Regulations of 1996 by amending the definition of "transfer note" in regulation 2(1) of the principal Regulations to include transfer notes that are required in Northern Ireland. Regulation 3 increases the maximum credit that landfill site operators may claim against their annual landfill tax liability in the scheme whereby operators are entitled to credit based on the contributions they give to approved bodies with objects concerned with the environment.
