Regional Act No. 20 laying down the legislative framework in matter of land use and land preservation.

The present Act provides for the protection of the territory of the Emilia Romagna Region by making rules on land use planning. Cooperation among the Region, the Provinces and the Communes in the field of land use planning and programming is hereby encouraged. Title I lays down general principles applicable to the elaboration of such plans. One of the main objectives is the protection of the environment and natural resources through the reduction or mitigation of impacts that may arise out of plans and projects.

Decree No. 8803 of 2002 regulating stone quarries.

This Decree is composed of 4 Parts divided into 4 chapters and 30 articles. Part I defines stone quarries and their places. Chapters I to IV deal with the following matters: the National Council for Stone Quarries; licences; exploiter’s obligations during and after the period of exploitation transfer; and, amendment and extension of licences. Investment allowances and compensations are dealt with in Part II. Parts III and IV contain violation seizures, penalties provisions, and transitional provisions.

This Regulation concerns the “exploration” intended as any operations on or over land or water to determine geologic conditions underlying the surface of land or water, and any operations that are preparatory to or otherwise connected with such activities and that, in the opinion of the Minister of Sustainable Resource Development, have the potential to cause surface disturbance. The Regulation is divided into 7 Parts and contains provisions on the licensing requirements and procedures.

Landfill Tax (Amendment) Regulations 2003 (S.I. No. 605 of 2003).

These Regulations amend the Landfill Tax Regulations 1996 to provide a number of changes to the scheme whereby landfill site operators are entitled to credit based on the contributions they give to approved bodies with objects concerned with the environment. Regulation 3 provides for amendments to regulation 31 which determines when a landfill site operator can claim tax credits and how he should calculate his entitlement to credit. The amendment reduces the maximum credit a landfill site operator may claim against their annual landfill tax liability.

Entry Level Agri-Environment Scheme (Pilot) (England) Regulations 2003 (S.I. No. 838 of 2003).

These Regulations, which apply to England, are made pursuant to section 98 of the Environment Act 1995, and provide for a grant to be made to any person who enters into an agreement with the Secretary of State requiring him to carry out activities which are conducive to a specified purpose on land in which he has an interest. The specified purposes are the conservation of the natural beauty or amenity of the countryside and the promotion of the enjoyment of the countryside by the public. Four pilot areas have been designated to reflect different uses of agricultural land in England.

Earthmoving Regulations.

These Regulations regulate earthmoving operations, i.e. any construction or other activity which disturbs or alters the surface of the land, coral reef or bottom of lagoons (reg. 1.3). All earthmoving operations in Micronesia shall be conducted in accordance with these Regulations and in such a way as to prevent accelerated erosion or accelerated sedimentation (reg. 2.1). Erosion and sedimentation control measures shall be set forth in a plan to be prepared by qualified persons in accordance with requirements laid down in reg.

Decree of the President of the Region No. 374 implementing article 50, paragraph 1-bis of Regional Act No. 16 of 2002 laying down provisions relative to the organizational and functional restructuring in matter of soil protection and water domain.

In implementation of article 50, paragraph 1-bis of Regional Act No. 16 of 2002, this Decree determines those waterworks and installations which may be realized by way of derogation from the prohibition laid down in the Regional Act above-mentioned. In fact, article 50, paragraph 1 of the Act prohibits the realization of waste disposal installations within 150 metres from the banks.

Foreshore Development Act (Cap. 90).

This Act concerns the protection and development of the foreshore, e.g. the land below mean high water mark and the bed of the sea within the territorial waters of Vanuatu (including the ports and harbours thereof) and including land below mean high water mark in any lagoon having direct access to the open sea. No person shall undertake or cause or permit to be undertaken any development on the foreshore of the coast of any island in Vanuatu without having first obtained the written consent to such development of the Minister responsible for town and country planning.

Council Directive 1999/31/EC on the landfill of waste.

The purpose of this Directive is to provide for measures, procedures and guidance in order to prevent or reduce negative effects on the environment (particularly the pollution of surface water, groundwater, soil and air) and of the global environment (including the greenhouse effect) as well as any other risk to human health that might result from landfilling of waste. For the purposes of this Directive, “waste” shall mean any substance or object which is covered by Directive 75/442/EEC.
