This Law, composed of two articles amends articles 95 and 96 of Act No. 4.504 regulating rights and obligations regarding rural real estates in order to implement the Agricultural Reform and to promote the Agricultural Policy.

Conservation Agreement Forms Regulation (Man. Reg.149/98).

The present Regulation implements the Conservation Agreement Act (Chapter C-173). It consists of 1 sections and 2 Schedules. Schedule A concerns the conservation agreement which allows landowners and conservation organizations to enter into agreements for the purposes of a) the protection and enhancement of natural ecosystems or their components, b) the protection and enhancement of wildlife or fisheries habitat, or c) the protection and enhancement of plant or animal species. Schedule B relates to the Notice of intent to file a caveat.

The present Regulation introduces some amendments to the Conservation Agreement Forms Regulation 149/98. In particular, it rewords section 1 dealing with the Schedules. Furthermore, the title of Schedule A is replaced.

The present Act implements the Conservation Districts Act (C-175). In particular, it refers to section 3 dealing with the Conservation Districts Commission.Subject to the approval of the Commission are: a) drainage improvement, development and maintenance; b) flood control; c) soil conservation; d) water conservation; e) recreation development; and f) such other programmes of resource conservation and development as the board may deem. The text consists of 20 sections.

Ministerial Decree No. 910 validating Regulation on land of protected areas.

The Ministerial Decree establishes that classification of land as protected area shall be the competence of the Government. Land use planning project with a view of land classification as protected area at the local level shall be submitted for approval to the territorial environmental, agricultural and land institutions. Expropriation of the plots of land destined for the annexation to protected areas shall be carried out in accordance with the land legislation. Land reservation for protected areas shall be carried out in accordance with the decision by the head of local administration.

The present Regulation implements the Crown Lands Act (Chapter C340). Section 2 establishes that a person who uses or occupies land under the authority of a permit, lease, licence or easement issued or granted by the minister under the above-mentioned Act shall pay the fee for that use or occupation that is required by the present Regulation. The text consists of 13 sections.

This Legislative Decree aims at land and environmental planning. The present Decree is composed of 20 articles. Article 1 deals with terms and definitions. Article 2 specifies the scope of this Decree. Article 3 defines requirements and conditions for the division of land. Article 4 decrees that the division of land or amendment of division should be adopted by the Ministry of Housing in accordance with provisions of this Decree and of its Implementing Regulations. Requirements and conditions for the division and planning of land shall be provided for in the Implementing Regulations (art.

Resolution No. 2 of 1997 issuing the Implementing Regulation of Legislative Decree No. 3 of 1994 on the division of lands destined for development and construction.

This Implementing Regulation explains and specifies provisions of Legislative Decree No. 3 of 1994 concerning land and environment planning. The Implementing Regulation is composed of 4 Sections divided into 59 articles. Section 1 deals with terms and definitions. Section 2 specifies the objectives of this Regulation as well as the basis and standards for the division of lands. Section 3 refers to procedures adopted for the division of lands. Section 4 deals with the following matters: (a) projecting provisions; (b) complaint affairs; (c) fees; and (d) offences and penalties.

The purposes of this Act are to designate development-restricted areas, to limit acts performed in such areas, to purchase lands and to efficiently manage development-restricted areas in order to prevent the proliferation of cities, and to sustain the conservation of the natural environment surrounding cities.An urban management planning with respect to the designation of a development-restricted are shall be formulated by the heads of central administrative agencies and determined by the Minister of Construction and Transportation.

Ministerial Decree No. 943 validating the Regulation on reservation of the plots of land for setting up and expansion of protected areas.

This Ministerial Decree regards reservation of the plots of land for setting up and expansion of the regional and local protected areas which shall be carried out in accordance with the program of the development of protected areas and ecological networks by decision of the regional and local executive powers. Territorial branches of authorized environmental institution shall draw up proposals and submit application to the local executive powers regarding reservation of the plots of land destined for protected areas.

Ministerial Decree No. 726 validating the Regulation on allotment of the plots of land for house-building.

This Ministerial Decree establishes the modalities of allotment free of charge to citizens for house-building of the plots of land of the total area of 0.10 ha. Recurring allotment of the plots of land free of charge to citizens for the aforesaid purpose shall be prohibited. Allotment of the plots of land into ownership to the foreign citizens and stateless persons shall be charged with the application of the use restrictions.
