Sand (Preservation) Act (XVI of 1949).

The present Act provides for the restriction on removal of sand. No person shall remove or carry away from any beach or sea shore or from any land or place, whether publicly or privately owned, any sand without a permit by the Director of Public Works. Section 7 establishes the penalties to be applied in case of contravention.

Fertile Soil (Preservation) Act.

This Act aims at preserving soil which is suitable or could be made suitable for purposes of agriculture. To this end, Section 3 lays down particular prohibitions. No person shall, inter alia: (a) transport certain quantities of fertile soil without the written permission of the Director of Agriculture; (b) render unsuitable fertile soil by mixing it with stones or by any other means; (c) cover fertile soil, unless it is considered necessary in connection with agriculture. Section 4 regards erection of buildings on areas where fertile soil exist. Sections 9 and 10 establish penalties.

La présente loi a pour objet de fixer les dispositions particulières relatives à la protection et à la valorisation du littoral. Elle porte définition du littoral et, à sen intérieur, de la zone côtière qui fait l'objet de mesures de protection et de valorisation spécifiques. Il est créé un commissariat national du littoral, organisme ayant pour mission d'établir un inventaire complet des zones côtières et qui servira a élaborer un système global d'informations et une cartographie des zones côtières. Il est institué un plan d'aménagement côtier.

National Parks and Gardens Ordinance (No. 70 of 1966).

There is established a National Parks and Gardens Board as a body corporate under section 4.The constitution of the Board is defined in section 6. Functions of the Board include the management of reserved land and the management of other land entrusted to its care. “Reserved land” means land reserved by the Administrator under the Lands Ordinance 1962-1965 as national park, reserve, or sanctuaries for fauna or flora protection or similar purposes. Powers of the Board are set out in section 16. The Board may make by-laws in accordance with section 24.

Preservation of Fertile Soil Regulations.

By way of implementation of the Fertile Soil (Preservation) Act, these regulations concern the submission of the application for transportation of fertile soil. According to regulation 3, no person shall, except upon permission from the Director of Agriculture, deposit any fertile soil on any land already covered with not less than three feet of fertile soil, or in any other manner which would render it unsuitable for immediate cropping.

Pas Geometriques Act.

This Act declares areas along the coast known as Pas Geometrique to be public domain and makes provision for the survey of lands in such kind of land areas, the grant of leases, rights of lessees, and prohibits dumping on Pas Geometriques. The Minister may grant leases of Pas Geometriques or annexes. The granting shall take place by private contract or public auction. A clause, which imposes the planting of trees on the lessee, shall be included in every lease contract. Cutting of trees on Pas Geometriques requires permission by the Minister and shall be included in the lease contract.

Natural Resources (Protection) Regulations (G.N. No. 774 of 1968).

No person shall without prior approval of the Board as defined in the Natural Resources Act cultivate or permit to be cultivated any land or destroy any vegetation in the vicinity of specified inland waters. The Board may, when granting approval, impose such terms as deemed necessary for the protection of natural resources. The Board may withdraw approval if a person fails to comply with the terms prescribed. (7 regulations)

Section 24 of the principal Act is amended in subsection (1) of section 24 by deleting the words “no person” and replacing them by the words “Notwithstanding any other enactment, but subject to section 24A, no person". Section 24 prohibits unauthorized setting up of jetties, alls, fences, groins or other structures on Pas Geometriques.

East Peninsula Land Development and Conservation Act, 1986 (No. 12 of 1986).

The South-East Peninsula Land Development and Conservation Board shall evaluate development schemes, make recommendations regarding allotment and reservation of land, control of pollution, implementation of environmental protection plans, monitor implementation of development schemes and carry out other functions set out in section 4. The Board shall prepare the South-East Peninsula Development and Land Use Management Plan in accordance with section 5.

This Act empowers the Director of Agriculture to make Land Preservation Orders under section 3 for purposes set out in subsection 2 of section 3. In such Orders the Director may, for reasons of protection of soil and other preservation of land, prohibit, regulate or control braking or clearing of land for cultivation, grazing of livestock, and the destruction of vegetation and may require or regulate afforestation, protection of slopes or catchment areas, drainage of land, supervision of abandoned land, and the use of land for agricultural purposes.
