Land Development Act.

This Act provides for the establishment of the Land Development Authority as a body corporate. It shall be the duty of the Authority to promote and assist the investigation, formation and carrying out of projects for the development, improvement and settlement of land. The Authority may establish a reserve fund. The Authority may make rules not inconsistent with the provisions of this Act.

This Order provides for the establishment of a corporation to be known as the Fiji Land Corporation for the purpose of purchasing freehold and leasehold agricultural estates and the developing, subdividing, selling or leasing of parts or the whole thereof, being a project planned by the Land Development Authority in the discharge of its functions under the Land Development Act.

Part II of this Order makes provision for implementing Council Directive 96/61/EC and for otherwise preventing and controlling pollution. It amends the transitional provisions in relation to waste management licenses in Article 47 of the Waste and Contaminated Land (Northern Ireland) Order 1997 and makes provision about certain expiring disposal licenses. Part III makes provision for implementing Council Directive 96/62 EC and for otherwise preventing and controlling air pollution. Part IV makes new provision with respect to areas of special scientific interest.

The ownership of the foreshore and sea-bed vests in the Crown, subject to the public rights of: (a) navigation and fishing, and (b) of passing over the foreshore, and to any private rights that may exist in or over the foreshore or the sea-bed. The Minister may by notice, after consultation with landowners, designate a foreshore of an island or islet or any part thereof. No person shall remove from a designated foreshore any sand, gravel, reef mud, coral, rock or other like substance without first having obtained from the Chief Lands Officer a licence for that purpose.

The Act concerns taking of private land by the State for public purposes, which are listed in this Act or which may, from time to time, be declared by the Head of State by Order. “Public purpose” includes "forestry, the control of coasts and rivers, the safeguarding of water, soil and forest resources, water supply, drainage, etc. Customary land and freehold land required for any public purpose may be taken by the Head of State, acting on the advice of the Minister, under the provisions of this Act.

The amendments concern the need for authorization from the Ministry of Natural Resources and Agriculture for the conversion of forest and valley land into the following: 1. making farmland, orchard, rangeland, artificial forests, forage land, livestock institutions, aquatic breeding institutions, as well as the use for mine exploting and exploration (in nothern Iran); and 2. establishment of factories, townships, schools, training institutions, sport clubs, etc.

Chapter one of this Law contains definitions of terms therein employed, such as: forest, forest bushes, desert shrubs, forest cover and regions, range, planted rangeland, logs and saplings. Chapter two sets out rules for exploitation and protection of the above mentioned areas. Forestry Organization, established within the Ministry of Agriculture, shall supervise and issue permits for each applicant regarding exploitation of these areas. Licence shall be valid up to one year.
