Regulations to implement provisions of the Mines and Minerals Act in general.The 61 regulations are divided into 13 Parts: Preliminary (I); Non-exclusive prospecting licence (II); Pegging of claims (III); Quarry permit (IV); Mineral right and objections (V); Royalty and transfers (VI); Mineral Dealer’s licence and export permit (VII); Residence/use of land (VIII); Surveys (IX); Keeping records of minerals (X); Retention of minerals (XI); Miscellaneous (XII); Water and timber rights (XIII).Non-exclusive prospecting licences shall be issued by the Inspector in accordance with provisions of Part II. The holder of a non-exclusive prospecting licence may peg claims in respect of land in accordance with regulation 7. Accepted claims shall be registered by the Inspector (sect. 16). The Certificate of Registration shall contain conditions subject to which a claim may be effected, including re-afforestation of forests areas and the rehabilitation of the soil. Regulation 24 imposes the same duties on holders of quarry permits issued under Part IV. Section 38 concerns the occupation of national land by a holder of a claim, quarry permit or mineral right. Every holder of a claim, permit or mineral right shall be entitled to the free use of water naturally flowing through or past the area subject to the claim, permit or right (reg. 56). Regulation 58 concerns the permission by the Minister to construct dams, water reservoirs, etc. The holder of a claim, permit or right shall be entitled to use timber on the land subject to the claim, permit or right in accordance with regulation 61.
