La présente loi porte régime foncier au Rwanda. Elle est formée par 88 articles répartis en 7 chapitres, à savoir: Dispositions générales (I); Catégorie des terres (II); Gestion, aménagement et utilisation des terres (III); Droits et obligations des titulaires de droits fonciers (IV); Prescription (V); Dispositions pénales (VI) et Dispositions transitoires et finales (VII). L'Etat dispose d'un droit éminent de gestion de l'ensemble des terres et est le seul habilité à accorder les droits d'occupation et d'usage de la terre.

The Act consists of 66 sections divided into 8 Parts: Preliminary (I); Establishment of Petroleum Resources Unit (II); Petroleum rights (III); Reports on exploration and discovery of petroleum (IV); Petroleum agreements (V); Rights and obligations of contractors and sub-contractors (VI); Miscellaneous (VII); Regulations (VIII).The Petroleum Resources Unit is established under section 3. This Regulation consist of 3 Chapters divided into 19 articles and it provides for the auction of land use rights in order to assign land with the collection of land use levies or to lease land. Article 3 specifies cases entitled to land assignment or land lease through auction. Conditions on land plots which have to be auctioned and conditions to participate to auctions are described in articles 5 and 6.

These Regulations determine the conditions, order, responsibilities and obligations of the state, municipal bodies, physical persons, etc. in implementing the Law for protection of agricultural lands. The Regulations are divided into 9 Chapters, and transitional and concluding provisions. Chapter 1 sets out general provisions. Chapter 2 provides for rights and obligations of individuals and specialised state bodies for the protection of agricultural lands from damage. Chapter 3 provides for the restoration and improvement of the productive quality of agricultural lands.

Decree No. 135/2005/ND-CP on contractual assignment of agricultural land, production forest land and land with water surface for aquaculture in state-run agricultural farms and forestry farms.

This Decree consists of 4 Chapters divided into 18 articles: General provisions (I); Contractual assignment of land for agricultural production (II); Contractual assignment of production forest land (III); Implementation provisions (IV). This Resolution is composed of 21 articles. Article 1 authorizes the creation of industrial zones outside cities and villages by a resolution issued by the Minister of Agriculture and Municipality Affairs including the site, area and borders which shall enter into force after the approval of the Council of Ministries. According to Decree No. 59 of 1989 and Resolution No. 10 of 1989 the lands destined for the industrial zones are considered Real Estate and can be only rent for the creation of the industrial zones (art. 2).

Law No. 13 of 1998 on the expropriation of land ownership and the temporary taking possession of them for public utilities.

This Law is composed of 4 Chapters divided into 25 articles. Chapter I deals with definitions and terms and defines the steps for the concession and exploitation of State lands. Chapter II provides for the definition of private State lands, concession rights, exploitation rights, ownership transfer and land leasing. Chapter III contains offences and penalties. Chapter IV gives general provisions necessary for the issuance of resolutions and regulations for the implementation of this Law.

Resolution No. 2 of 1990 establishing the Complaint Central Committee related to the expropriation of lands for public utilities.

This Resolution is composed of 12 articles. Article 1 deals with the establishment and management of the Central Committee for Complaint related to the land expropriation for public utilities under the control of the Minister of Agriculture and Municipality Affairs. Article 2 defines duties and competencies of the Committee provided for in Law No. 13 of 1988 in particular: ownership expropriation compensations; ownership and owner’s rights of temporary expropriated lands . Article 6 decrees the establishment of the Complaint Register at the Expropriation Department.
