The present Regulation establishes the modalities of issue and cancellation of special permits for removal and transfer of the fertile soil layer of the plots of land. The provisions of the Regulation establish the modalities of application for obtaining special permit for removal and transfer of the fertile soil layer of the plots of land that are compulsory for land users whose activity is related to the disturbance of the upper (fertile) soil layer.

Order No. 434 of the Ministry of Environmental Protection validating the Regulation on the modalities of approval by the environmental institutions of the materials regarding expropriation (purchase) and allotment of the plots of land.

The present Regulation is applicable to the Ministry of Environmental Protection and its territorial branches (environmental institutions). The Regulation establishes the mechanism of approval by the environmental institutions of the selection of the plots of land for the location of the objects thereon, allotment of all categories of land irrespectively of the form of ownership and land tenure.

The Regulations establish a scheme (the “Environmental Stewardship”) under which the Secretary of State may make grants for the management of land. Regulation 3 enables the Secretary of State to make a grant to any person who enters into, and complies with, the conditions of an environmental stewardship agreement with the Secretary of State. The agreement must require the beneficiary to carry out an activity which is conducive to a specified purpose on land in which he has an interest. It also provides for the variation of the conditions of such agreements.

This Act establishes the National Heritage Fund as a body corporate, defines its functions and provides for its internal organization. This shall be done in a balanced and ecologically sustainable manner for the benefit of the residents of the county and particularly as so as to enhance Sami culture, reindeer husbandry, use of non-cultivated areas, commercial activity and social life. The Act shall apply to real property and watercourses with natural resources in the county of Finnmark. On the shoreline, the Act shall apply as far out to sea as private right of ownership extends.
